Tax avoidance/evasion - Wikipedia, the free encyclopedia
Tax evasion usually entails taxpayers deliberately misrepresenting or concealing the true state of their affairs to the tax authorities to reduce their tax liability, and includes, in particular, dishonest tax reporting (such as underdeclaring income, profits or gains; or overstating deductions).
Tax avoidance is the legal exploitation of the tax regime to one's own advantage, to attempt to reduce the amount of tax that is payable by means that are within the law whilst making a full disclosure of the material information to the tax authorities.
By contrast tax evasion is the general term for efforts by individuals, firms, trusts and other entities to evade the payment of taxes by illegal means.

Corporate Tax Evasion on an Enormous Scale
Though the corporate tax rate is 35 percent, the IRS found that the 10,000 largest corporations paid only 20.3 percent of their 1999 profits in federal income taxes.
Corporate profits, and the taxes that should be paid on those profits, are flooding into the investment portfolios and bank accounts of corporate executives.
But the largest single contributor to this evasion of taxes is the lavish awarding of the stock options to corporate executives.

TaxProphet Hot Topics - February 1996
Clearly, you and I are "individuals" and are liable for federal taxes.
In Cheeks, the taxpayer, who was convicted of tax evasion for failing to file income tax returns, argued that he was, in effect, "duped" by the tax protestor rhetoric and honestly believed that he was not a taxpayer under the Internal Revenue Code.
Tax protestors often point out that the word "individual" is not defined in the Code or regulations, and conclude that they are not individual U.S. residents or citizens subject to federal income tax.

 Tax Protester FAQ
So the income tax is a tax on the receipt of income, and the sale of labor is a transaction that allows the constitutional imposition of a tax.
The federal income tax is unconstitutional because it is a "direct tax" that must be apportioned among the states in accordance with the census.
The court decisions against tax protesters are all rendered by ignorant, corrupt judges who have a vested interest in maintaining the status quo because their salaries are paid by the income tax and they are not going to bite the hand that feeds them.

Tax Protest Movement -- Extremism in America
A tax protester, however, regardless of whether he or she actually attempts to evade paying taxes, is someone who has become convinced that they have a moral, ethical or legal right or responsibility to refuse to pay taxes.
Tax protesters engage in a wide variety of tax evasion strategies that range from simple refusal to pay taxes to complicated schemes using onshore and offshore trusts in order to hide income from the government.
Many tax protesters moved easily from believing that the tax laws were illegitimate to concluding that the entire government was in various ways illegitimate.

 Nonfiler Enforcement Program
Employment tax evasion schemes have serious consequences not only for the employers but the employees as well.
The requirement to file an income tax return is not voluntary and it is clearly set forth in the Internal Revenue Code (IRC) Sections 6011(a), 6012(a), et seq., and 6072(a).
Currently, the same arguments concerning the legality of the tax system are being used in an attempt to convince employers they do not have to withhold employment taxes.

Irwin Schiff calls Otto Skinner a Liar - You be the Judge!
A tax on wages or a tax on dividends is a tax on the source.
For tax purposes the word income means a corporate profit because when the government puts a tax on corporate profit it is taxing income separated from the source.
The tax under consideration, as we have construed the statute, may be described as an excise upon the particular privilege of doing business in a corporate capacity, i.e., with advantages which arise from corporate or quasi-corporate organization; or, when applied to insurance companies, for doing the business of such companies.

Promoters of abusive tax transactions are increasingly urging taxpayers to transfer assets into trusts.
But the tax code firmly establishes that a clear business purpose and profit motive must exist in order to generate and claim allowable business expenses.

In support of tax evasion, by Pierre Lemieux (The Globe and Mail)
If Canadians in the underground economy were to start paying their "fair" taxes, government revenues and expenses would just increase by the amount of the new taxes.
As budget day nears, politicians of all stripes warn us that tax evasion is rampant in Canada.
In two words, tax evasion is a response to tax invasion.

Fuel Tax Evasion - Office of Transportation Policy Studies - FHWA
Loss of revenue due to tax evasion is an on-going issue that is being addressed at Federal and State levels.
Revenues from motor fuel and other highway use taxes provide the primary source of funding for our nation’s transportation system, and ensuring all of these taxes are collected, remitted, and credited to the Highway Trust Fund is a priority for FHWA.
Revenue and enforcement agencies are working together in the Joint Federal/State Motor Fuel Tax Compliance Project to address the issue of motor fuel tax evasion through audit and enforcement efforts as well as through advances in technology.

With tax reform high on the political agenda, this book brings together studies of leading tax economists and lawyers to assess the various reform proposals and examine the effects of tax reform in several distinct areas.
One approach primarily involves spending cuts and smaller government, another relies more heavily on tax increases to support an activist government, and the third suggests a balanced mix of spending cuts and tax increases along with a reallocation of government priorities.

MARICLE had prepared their tax returns in connection with his role as a promoter of the AEGIS system, a scheme which entailed the use of abusive trusts in order to hide income and evade the payment of income taxes.
The trusts, in fact, provided no tax shelter and had no effect on transferring assets or reducing or eliminating the clients' income tax liabilities, according to the indictment.

Frauds and Scams Introduction Crimes of Persuasion - A Resource for Investigators
Ok, that sets the stage - in 1895, the Congress had the Constitutional authority to impose and collect taxes with the stipulation that all direct (property) tax revenue had to be distributed according to census.
Direct taxes, by definition, are those taxes related to real property - all other taxes are excise taxes including taxes on "wages, tips and other compensation."
All the 16th Amendment actually did was allow the Congress to continue taxing all income, from whatever source, without being concerned with apportionment issues.

Microsoft Korea is disputing the remaining balance of the initial US$59 million tax assessment, saying that the allegation arose from a difference of opinion between the company and the tax authorities over the way imported software products are priced.
The Korean subsidiary was charged with inflating expenses by overstating the cost of software imported from its U.S. parent company, thus underreporting its income.
