 The European Economic Area (EEA) - Overview
All new Community legislation in areas covered by the EEA is integrated into the Agreement through an EEA Joint Committee decision and subsequently becomes part of the national legislation of the EEA EFTA States.
The Agreement also includes areas which have an impact on the competitive position of enterprises, such as consumer protection, environment and certain elements of company law.
Where the EEA-EFTA States are admitted to participate in these programmes, they contribute to the budgets of the programmes in question and participate in the committees that manage them, but with no right to vote.

 The EFTA Secretariat: The EEA Agreement
The Annexes to this Agreement and Protocols 1 to 7, 9 to 11, 19 to 27, 30 to 32, 37, 39, 41 and 47, as appropriate, may be amended by a decision of the EEA Joint Committee in accordance with Articles 93 (2), 99, 100, 102 and 103.
The aim of this Agreement of association is to promote a continuous and balanced strengthening of trade and economic relations between the Contracting Parties with equal conditions of competition, and the respect of the same rules, with a view to creating a homogeneous European Economic Area, hereinafter referred to as the EEA.
The EEA Consultative Committee may express its views in the form of reports or resolutions, as appropriate.

The latest developments are a report issued by the European Parliament on 28 June 1998 which deals with Audio-Visual Services and a draft decision of the EEA Joint Committee which aims at amending Annex XXI to the EEA Agreement by adding legislation in the field of statistics which has already been adopted in the EU.
In May 1998 the EEA Joint Committee drafted a decision which aims at the integration of Community legislation in the EEA Agreement, especially concerning the application of the principles of Open Network Provision - ONP - and a coordinated authorisation approach in the field of satellite personal-communication services.
The EEA Joint Committee has recently drafted a decision which seeks to amend Annex XIII - Transport - of the EEA agreement.

European passport: In general, jurisdictions responded that if the subsidiary or affiliate of a U.S. firm is authorized by the competent authority of another Member State, such entity may establish a branch or conduct cross-border investment services activities into their jurisdiction under the European passport.
Under the European passport, the subsidiary or affiliate of a U.S. entity located in another Member State may establish a branch in Austria to conduct investment services or may conduct cross-border investment services activities to the extent such activity is permitted by the home Member State without separate authorization.
A U.S. entity whose economic operating conditions and management fulfill the requirements set for the provision of reliable investment services shall be granted the authorization for establishing a branch in Finland.

However this is not true when one considers that financial reforms were already underway in many EFTA states prior to the start of negotiations, as these states had already recognised the need for such reforms for the sake of their own financial markets and for their industries generally.
Thus Switzerland's non-participation in the EEA arrangements at this stage will mean that a relatively large European financial market will not come under the scope of the financial services internal market legislation.
These requirements do not of course apply to EEA established companies as they are considered to be adequately covered by the requirements imposed on the parent company by the Directives.
